With these privacy and cookie terms we would like to properly inform you on our privacy and cookie policy.

Trainin BV - the manager of the trainin.com, trainin.nl, trainin.be, trainin.app and trainin.co websites - considers it important that your Personal Data are handled carefully. Your Personal Data are processed in accordance with the requirements of the General Data Protection Regulation (GDPR) and other applicable laws and regulations. Personal Data are carefully processed and secured by us.

Personal Data and processing

What are Personal Data?

Personal Data is any information that identifies a natural person (direct Personal Data) or can be used to identify a natural person (indirect Personal Data). Personal Data include, for example, your name, date of birth and telephone number.

What are special Personal Data?

Special Personal Data are Data that may be more sensitive than 'normal' Personal Data. These are, for example, data about someone's political preferences or health.

What does the processing of Personal Data involve?

All operations that an organisation can perform with Personal Data, from collection to destruction, are processing operations. In any case, processing includes: the collection, recording, organisation, storage, adaptation, alteration, retrieval, consultation, use, forwarding, dissemination, making available, alignment, combination, blocking, erasure and destruction of Data.


Purpose of Data processing

Entering into and performing an agreement

We process your Personal Data for entering into and performing agreements for our services and maintaining the relationships resulting from those agreements. For the services and tools, we provide via our websites among others, we process certain Personal Data about you to enable us to provide our services in the best possible way. If we do not obtain from you all Personal Data requested by us, we may not be able to provide our services to you or to provide them to you in the best possible way.

For entering into a Trial account or a Paid account, we process the following Personal Data about you:

  • Company name, name of contact (first name and last name), company address, business registration number, VAT number, email address, telephone number, (digital) signature and bank details.

  • The following data of your Members may be processed: Name (first name and last name), email address, telephone number, emergency telephone number, address, gender, date of birth, company details, financial data, profession, tag ID.

  • The following data of your Employees may be processed: Name (first name and last name), email address, telephone number.

  • We may process calendar items, notes, messages, documents and photos when you, your Members or your Employees add or upload these in your Account.

  • We may process device information or technical data from you, your Members or your Employees: Login data, device ID, device name, browser type and version.

We keep these Personal Data during the contract term. We subsequently destroy your Personal Data, within a maximum of 60 days for a Trial account and for a Paid account, unless there is a legal obligation to keep them longer or if we have a justified interest. In that case we keep the Personal Data as long as necessary and/or to fulfil our legal obligation.

Contact with Trainin BV

When you contact us through one of our contact channels, we will keep your Personal Data as long as necessary for the complete processing of your question or reaction. When you send us (special) Personal Data through these channels, you also consent to the processing of these (special) Personal Data.

Newsletter

When you create an Account with us, you can subscribe to our newsletter. We use your first and last name and e-mail address for this. After subscribing to our newsletter, you can expect emails from us with information about our services, such as updates on new developments and promotional activities related to our services. At the bottom of the mailing list, you will find a link to unsubscribe from the mailing list at any time by clicking this link.


Right of access, amendment and objection

You may ask us in writing to enforce your rights below that you have under the GDPR, unless we have a justified interest not to do so, or unless this is not possible on a legal basis:

  • Right to access your Personal Data;

  • Right to amend your Personal Data, if they contain inaccuracies;

  • Right to request what we do with your Personal Data;

  • Right to have your Personal Data deleted;

  • Right to data portability (the right to receive and/or transmit your Personal Data);

  • Withdrawing consent;

  • Objecting to a particular use.

Please make sure you clearly identify who you are so that we can be sure to amend or delete your Personal Data. If necessary, we will contact you before proceeding with your request and we may require additional information from you to establish your identity.


Transfer to third parties

We do not provide or sell your Personal Data to third parties, such as other companies or organisations, unless this is necessary for the performance of our services and unless we are required to do so by law. The companies to which it may be necessary for the performance of our services to provide (Personal) Data can be found in Annex 3 of the Data Processing Agreement.

If you contact us via Meta (Facebook, Instagram, WhatsApp), the submitted (Personal) Data will also be processed by these third parties.

(Personal) Data will also be processed outside the EEA via the above third parties.


Acquisition from third parties

When Trainin BV obtains Personal Data from third parties, or if they are collected via these third parties, Trainin BV observes the same carefulness as if it had obtained these Personal Data itself.


Third party websites

Our website may contain references, for example by means of a hyperlink, to other websites of third parties. We cannot guarantee that these third parties will handle your Personal Data carefully and securely. We refer you to the privacy terms of these third parties to see how these parties handle your Personal Data. These may differ significantly from the privacy and cookie terms of Trainin BV.


Security

We take security measures to protect your (Personal) Data as well as possible against unauthorised access or unauthorised modification, disclosure, destruction or misuse of your Data. To this end, we have taken appropriate technical and organisational measures.


Complaints

If you have a question or complaint regarding the processing of your Personal Data, you can always contact us. You also have the possibility under the GDPR to lodge a complaint with the Dutch Data Protection Authority against the processing of your Personal Data. In that case, you can contact the Dutch Data Protection Authority.


Liability

Should your (special) Personal Data, despite Trainin BV's best efforts to prevent this, be lost (including misappropriation and destruction), processed in an unlawful and/or unauthorized manner, thereby potentially causing you to suffer any direct or indirect damages, we hereby exclude liability for any damages unless the damages are the result of wilful intent or recklessness bordering on wilful intent on the part of Trainin BV.



Use of Cookies


What are cookies?

Trainin BV uses cookies on this website. A cookie is a small information file sent with pages of a website and stored or read by your browser on the hard drive of your devices such as your computer, tablet, mobile phone or other peripheral device.

The first time you visit our website, a message will appear informing you that we use cookies. You can specify which cookies you want to have placed on your computer. If you continue to use our service, we will assume that you do not object to our cookies.


Enabling and disabling cookies

Types of cookies

Functional cookies

We use functional cookies. These cookies are necessary to use our website. We also use first-party cookies: these are placed by our website itself and used to make it work better.

Google Analytics

Through our website, cookies are placed by Google as part of the 'Analytics' service. These cookies measure the use of our website. These cookies allow us to see, for example, how many visitors visit a specific page on our website. The basis for processing via Google Analytics is based on our justified interest. The information thus obtained, including the address of your system (IP address), is transferred to and stored by Google on servers in the United States. We have set up Google Analytics to be privacy-friendly. You can read more about these services in Google's privacy policy.

Social media buttons

This website includes buttons that allow pages to be promoted or shared on the following social networks, among others: Facebook and Instagram. When you click a social media button on our website, a social media cookie is placed on your computer. These cookies are not placed by Trainin BV but by the social media parties themselves. Please refer to the privacy and cookie statements of these social media networks to find out how these parties handle your Personal Data and what cookies may be placed. These terms may differ significantly from the privacy and cookie terms of Trainin BV.


Storage periods and deletion of cookies

Many cookies have an expiry date. When this is reached, the cookies expire automatically. You can also delete cookies manually before they expire. Consult the manual of your browser.


Changes to privacy and cookie terms

Trainin BV reserves the right, without prior notice, to make changes to these privacy and cookie terms at any time.


Invalid

In the event any provision(s) or part(s) of these terms are invalid or invalidated, the remaining provisions shall remain in full force and effect and the invalid or invalidated provision(s) of these terms shall be replaced by (a) new provision(s) permitted by law. The purpose and meaning of the original invalid or invalidated provision(s) shall be taken into account as much as possible.

If any ambiguity exists regarding the interpretation of one or more provisions of these terms, or if a situation arises between the parties which is not provided for in these terms, then the explanation should be given and these terms should be acted upon "in the spirit" of these provisions or these terms, respectively.

In the event of any conflict between the Dutch and the English terms and conditions, the Dutch terms and conditions will prevail.


Applicable law

These privacy and cookie terms are governed by Dutch law. All disputes arising out of or in connection with these terms shall be resolved by the court within whose district Trainin BV has its registered office.
